These Export and Shipping Terms ("Shipping Terms") outline the terms and conditions for the export and delivery of products sold by a1 (Xiamen) Food Technology Co.,Ltd. ("a1®", "we", "us", or "our") to international customers. By placing an order for export, you ("Buyer") agree to be bound by these Shipping Terms.
All shipments are conducted in accordance with the Incoterms 2020. The default delivery term is FOB Xiamen Port, EXW a1® Factory, or CIF Destination Port, as mutually agreed upon in the sales contract or purchase order. The risk of loss or damage to the products passes to the Buyer in accordance with the chosen Incoterm.
The shipment of goods shall be arranged in accordance with the Incoterms 2020 as expressly agreed in the applicable sales contract or purchase order.
For FOB or CIF shipments, a1® will arrange for the carriage of goods to the named port or destination of shipment, and we partner with reputable freight forwarders and shipping lines to ensure timely delivery.
For EXW (Ex Works) shipments, the Buyer is solely responsible for all transportation arrangements, including but not limited to, arranging for the collection of goods from a1®'s designated factory or warehouse, and for all associated costs, risks, and documentation from that point forward. a1®'s obligation is limited to making the goods available at its premises.
The Buyer is responsible for providing accurate shipping and customs clearance information. Any delays or costs arising from inaccurate or incomplete information provided by the Buyer shall be borne by the Buyer.
For shipping weights, dimensions, and container types (e.g., FCL, LCL), a1® will coordinate with the Buyer to select the most efficient and cost-effective method, based on the agreed Incoterm.
Title to the products and the risk of loss or damage to the products shall pass from a1® to the Buyer according to the agreed Incoterm stated in the purchase order.
The Buyer is the importer of record and is solely responsible for complying with all import regulations, customs clearance procedures, and for paying all applicable import duties, taxes, customs fees, and other governmental charges in the destination country.
a1® will provide the necessary export documentation, such as the Commercial Invoice, Packing List, and Certificate of Origin, to facilitate customs clearance. However, we do not assume liability for delays or additional costs caused by customs authorities.
a1® will provide the following standard export documents:
Any claims for damage, loss, or shortage of products must be reported in writing to a1® within 7 business days of receipt of the shipment.
Claims against the carrier for damage or loss during transit shall be the responsibility of the Buyer, but a1® agrees to assist in the claims process by providing necessary documentation.
a1® products are manufactured in facilities that hold internationally recognized certifications, including BRC, FSSC22000, HACCP, US FDA registration, BSCI, and Halal, demonstrating our commitment to food safety and quality. It is the Buyer's responsibility to ensure that the importation of these products complies with all local food safety and labeling regulations in their country.
These Shipping Terms shall be governed by and construed in accordance with the laws of the People's Republic of China.
